SUSPENDING THE WRIT OF HABEAS CORPUS
The writ of habeas corpus is a inalienable right guaranteed to every American. It is a fundamental tool.used to ensure that individuals are not unlawfully detained. It allows individuals to challenge the legality of their detention, demanding that the detaining authority produce the person before a court and justify their continued confinement. The right of habeas corpus can be found in Article 1, Section 9, clause 2 of the Constitution. Since this clause is in Article 1 suspension of this right would take an act of Congress. Habeas corpus can only be suspended for a rebellion or an invasion. The right of habeas corpus, however; has been suspended just twice in American history. Both times it was done by the president and not Congress. It was suspended by Lincoln during the Civil War and Roosevelt in Hawaii after Pearl Harbor. In both cases it was directed at American citizens primarily.
If President Trump is forced to suspend habeas corpus it will be directed at illegal aliens and not at American citizens. The argument can be made that illegals are not subject to the same rights as American citizens. I feel like President Trump will suspend the writ of habeas corpus by this Summer if the Supreme Court or Congress does not step up to the plate and limit the power of rogue Communist judges who are blocking deportations. Trump can justify this on the basis that America has been invaded and illegals are not subject to the same constitutional rights as American citizens. Realistically if Trump does not do this we will never come close to deporting the numbers of illegals necessary to secure our safety and to provide for the America's general welfare.
